Law and Economics methodology is applied to detail the impacts of legal rules of liability over the incentives to preventive behavior of banks. The main point of the text was finding out which is the type of liability which provides the best and more efficient incentives to investments in damage prevention. Finally, it is provided an analysis about the role of proactive internal sustainability policies of benchmark companies to the evolution of the minimum legal requirements of the applied liability rule.
